1. Agreement to Terms

By accessing or using Dizest: AI Summarizer ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and 116 Ideas, Inc. ("Company," "we," "us," or "our"). The Service is operated by 116 Ideas, Inc..

1.1 Apple App Store Users

This End User License Agreement (EULA) is between you and 116 Ideas, Inc., not Apple. 116 Ideas, Inc. is solely responsible for the Dizest: AI Summarizer app and its content.

The license granted to you for Dizest: AI Summarizer is limited to a non-transferable license to use the app on Apple-branded products you own or control, and as permitted by the App Store Terms of Service.

Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

In the event of any conflict between this EULA and the App Store Terms of Service, the App Store Terms of Service shall control with respect to your use of the Dizest: AI Summarizer app on any Apple-branded device.

2. Service Description

Dizest: AI Summarizer is an AI-powered summarization service that uses Large Language Models (LLMs) and other artificial intelligence technologies to analyze and summarize various types of content including articles, videos, documents, and other media.

The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. Maintenance and Support

116 Ideas, Inc. is solely responsible for providing any maintenance and support services for the Dizest: AI Summarizer app as specified in these Terms or as required under applicable law.

For App Store Users: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app. Any support inquiries should be directed to 116 Ideas, Inc. at [email protected].

4. AI-Specific Disclaimers and Limitations

4.1 No Accuracy Guarantees

The Service uses artificial intelligence and Large Language Models (LLMs) to generate summaries and other content. AI-generated content may contain inaccuracies, errors, hallucinations, biases, or misleading information.We make no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any AI-generated content for any purpose.

4.2 Independent Verification Required

You acknowledge and agree that you are solely responsible for verifying the accuracy of any AI-generated content before relying on it for any purpose, especially for important decisions, professional use, medical advice, legal matters, financial decisions, or any other critical applications.

4.3 No Professional Advice

The Service does not provide professional advice of any kind, including but not limited to medical, legal, financial, or tax advice. AI-generated summaries and content should not be used as a substitute for professional consultation or expert opinion.

4.4 Limitation of Liability for AI Content

To the maximum extent permitted by law, we shall not be liable for any damages, losses, or harm arising from your use of or reliance on AI-generated content, including but not limited to direct, indirect, incidental, consequential, or punitive damages.

5. Subscriptions and Billing

5.1 Subscription Plans

The Service offers various subscription plans with different features and pricing. Subscription details, including pricing and features, are displayed within the application and may be updated from time to time.

5.2 Platform-Managed Subscriptions

Subscriptions are managed through third-party platforms including:

• Apple App Store (for iOS users)
• Google Play Store (for Android users)
• Our own billing system (for web and other platforms)

When you subscribe through a third-party platform, you agree to that platform's terms of service and payment policies in addition to these Terms. Billing, payment processing, and subscription management are handled by the respective platform.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You will be charged for the next billing period unless you cancel your subscription before the renewal date.

5.4 Cancellation

You may cancel your subscription at any time through the platform where you subscribed:

• Apple App Store: Manage subscriptions in your Apple ID account settings
• Google Play Store: Manage subscriptions in your Google Play account
• Web/Direct: Manage subscriptions in your account settings

Cancellations take effect at the end of the current billing period. You will retain access to premium features until the end of your current subscription period. No refunds or credits will be provided for partial subscription periods.

5.5 Price Changes

We reserve the right to modify subscription pricing at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. You will be notified of price changes in advance, and you may cancel your subscription before the new pricing takes effect.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited activities include, but are not limited to:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights of others
• Transmitting harmful, offensive, or inappropriate content
• Attempting to gain unauthorized access to the Service or related systems
• Interfering with or disrupting the Service or servers
• Using the Service for any commercial purpose without authorization
• Reverse engineering, decompiling, or disassembling any part of the Service
• Using automated systems or bots to access the Service
• Storing, caching, or creating a database of search results provided by the Service, other than transient storage required for normal use of the Service
• Redistributing, reselling, or sublicensing any search results or third-party content obtained through the Service
• Using search results or other content obtained through the Service to create, train, fine-tune, benchmark, or otherwise improve any artificial intelligence model or machine learning system

7. Reverse Engineering Prohibition

You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying ideas or techniques of the Service or any software, documentation, or data related to the Service.

This prohibition includes but is not limited to attempting to derive the prompts, training data, model architectures, or any proprietary methods used in our AI systems. Violation of this provision may result in immediate termination of your account and legal action.

8. Intellectual Property Rights

8.1 Service Ownership

The Service, including all software, algorithms, designs, text, graphics, logos, and other content (excluding user-provided content), is owned by 116 Ideas, Inc. and is protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze your content solely for the purpose of providing the Service to you.

8.3 AI-Generated Content

AI-generated summaries and content created by the Service are provided to you for your personal use. You may use AI-generated content subject to these Terms, but you acknowledge that similar or identical content may be generated for other users based on similar inputs.

8.4 Intellectual Property Infringement Claims (App Store)

In the event of any third-party claim that the Dizest: AI Summarizer app or your possession and use of the app infringes that third party's intellectual property rights, 116 Ideas, Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9. Third-Party Services and Content

9.1 Third-Party Search Providers

The Service uses third-party search providers to locate and retrieve content. When you use search features within the Service, your search queries may be shared with these third-party providers to deliver results. By using the Service, you consent to the transmission of your search queries to our third-party search providers in accordance with our Privacy Policy.

9.2 Third-Party Content

The Service may display, reference, or link to content owned by third parties. Such third-party content is provided "as is" and may be subject to the intellectual property rights of its respective owners. We make no representations or warranties regarding third-party content and are not responsible for its accuracy, completeness, or legality.

9.3 Third-Party Platform Terms

Your use of the Service is also subject to the terms and policies of the third-party platforms and services we rely on to provide the Service. In the event of any conflict between these Terms and the terms of a third-party platform with respect to your use of that platform, the third-party platform's terms shall control.

11. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Service will meet your expectations
• Any errors in the Service will be corrected

11.1 Apple App Store - Warranty Disclaimer

116 Ideas, Inc., not Apple, is responsible for addressing any claims you or any third party have relating to the Dizest: AI Summarizer app or your possession and/or use of the app, including but not limited to:

• Product liability claims
• Any claim that the app fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection or similar legislation

Apple has no warranty obligation with respect to the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be 116 Ideas, Inc.'s sole responsibility.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 116 IDEAS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Reliance on AI-generated content or summaries

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless 116 Ideas, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in California, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

14.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically to stay informed about our terms and conditions.

16. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
